1. Acceptance of Terms

By accessing or using our service (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Service.

2. Service Description

The Service is a SaaS platform providing an AI-powered website chatbot widget (“Widget”).
The Widget:

  • Is installed on a website by its owner

  • Uses AI inference to respond to user queries

  • May personalize responses based on the page being viewed and other non-personal context

  • Does not guarantee accuracy, completeness, or reliability of the AI responses

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied.

3. Eligibility

  • Users must be at least 18 years old to register or use the Service.

  • Access is prohibited for individuals or entities located in countries under applicable trade sanctions, embargoes, or export control laws.

  • By using the Service, you confirm that you meet these requirements.

4. Registration & Accounts

  • Registration is open to all eligible users.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • The Service may suspend or terminate accounts without prior notice for violations of these Terms.

5. Payments & Billing

  • Paid plans are available via Paddle as the payment processor.

  • All fees are charged in advance and are non-refundable (“no refund policy”).

  • Subscriptions automatically renew unless cancelled before the renewal date.

  • You authorize Paddle to charge your payment method for recurring fees.

6. Prohibited Uses

You may not use the Service for:

  • Illegal activities

  • Distribution of malware or harmful code

  • Infringement of intellectual property rights

  • Creation or distribution of disinformation

  • Violation of third-party privacy rights

  • Reverse engineering, decompiling, or copying the Widget or its functionality

7. AI-Generated Content Disclaimer

  • Responses are generated automatically using third-party AI providers (OpenAI, Google Gemini, Groq).

  • The Service does not guarantee factual accuracy, timeliness, or completeness of responses.

  • The website owner is solely responsible for the accuracy and legality of the knowledge base and public website content used to train the Widget.

  • The Service shall not be used in high-risk domains (medical, financial, legal) as a substitute for professional advice.

8. Intellectual Property

  • The Service code, design, and infrastructure are the exclusive property of PE “Maksym P.”

  • AI-generated responses are produced by the AI providers and are not owned by the Service.

  • All data and documents provided by the website owner remain their sole property.

  • Website owners are free to use, display, and store AI responses generated by their own instance of the Widget.

9. Termination

  • The Service reserves the right to suspend or terminate any account or site access at any time without notice if these Terms are violated.

  • Upon termination, all rights granted to the user will immediately cease.

10. Limitation of Liability

  • To the maximum extent permitted by law, the Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

  • The total liability of the Service for any claim shall not exceed the amount paid by the user in the month preceding the claim.

  • The Service is not liable for damages resulting from actions or inactions of third-party AI providers.

11. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed under the laws of Ukraine.

  • Any disputes shall be resolved through a mandatory pre-trial negotiation process before resorting to court or arbitration.

12. Changes to Terms

  • The Service may modify these Terms at any time.

  • Updates will be communicated via Email and the Blog.

  • Continued use of the Service after changes constitutes acceptance of the updated Terms.
